On February 19, 2021 in Lviv, Ukraine, an international scientific-practical conference on "Forensic examination of intellectual property" was held online (via ZOOM) with the participation of people from a number of countries.
Yusif Allahverdiyev, a member of the Azerbaijani Bar Association, attended the conference.
Lawyer Yusif Allahverdiyev spoke on "Peculiarities of appointment of expertise by courts" and spoke about the recent judicial reforms in the country, in particular, he stressed the importance of the Decree of the President of the Republic of Azerbaijan dated April 3, 2019 on the deepening of reforms in the judicial system to address the existing problems and issues in this area.
It was noted that the decree clarifies the terms of conducting forensic examinations and issuing expert opinions on civil cases, as well as cases on administrative offenses, commercial and administrative disputes, expansion of the rights of participants in court proceedings in connection with the appointment of expertise, alternative mechanisms of forensic activity, as well as the acquisition and study of international experience in the implementation of expertise by private entities.
Relevant working groups were established within the framework of resolving the issues arising from the decree, and a package of amendments to the legislation prepared by the working groups was discussed and adopted in the Parliament. One of the important directions was the expansion of the rights of litigants to conduct forensic examinations, the establishment of a new legal institution - a private forensic institute, which resulted in the timely execution of court decisions on examinations and the expansion of the rights of the parties. This means legal stability and trust in the law.
Then other participants of the conference made speeches on the topic, problems in this area were voiced, views were exchanged on their solutions.
