Chairman Anar Bagirov and a member of the Presidium Mukhtar Mustafayev represented the ABA during the second Congress of Kyrgyz Lawyers, which was also attended by the President of Kyrgyz Republic Mr. Sadyr Japarov.
Leaders of government institutions of the Kyrgyz Republic, including the Bar Associations of Kyrgyz Republic, Azerbaijan, Russia, Belarus, Uzbekistan, and representatives of international organizations were among the guests and participants of the Congress.
Opening the congress, President of the Kyrgyz Republic Sadyr Japarov noted that lawyers are one of the pillars of the rule of law and protection of human rights and stressed the need for lawyers to be independent in their professional activities, and not to be influenced by external factors.
At the same time, Mr. Japarov spoke about the serious reforms and changes in the state building, economy, social sphere, law enforcement, and judicial system in the independent development of the Kyrgyz Republic over the past 30 years.
Mr. S. Japarov informed the guests that during the implementation of these reforms, more attention was paid to law enforcement and judicial activities, and advocacy was kept in the background.
Earlier, he spoke about the Law of the Kyrgyz Republic "On the Bar Association and Advocacy", the non-implementation of some of its provisions, including issues related to land issues of the Bar Association of the Kyrgyz Republic and its affiliates, and noted that each of these issues has been resolved. Additionally,S.Japarov stressed the necessary conditions that have been created for the activity of the Bar Association of Kyrgyz Republic, as well as the increased amount of legal aid provided at the expense of the state, etc.
Sadyr Japarov spoke about the first meeting of the Council for the Improvement of Law Enforcement Activities under the President in June 2021, which gave impetus to the implementation of the next stage of judicial reform, adding that the implementation of judicial reform and judicial legislation will lead to appropriate changes, as illegal decisions will be rejected by independent and competent courts with the active participation of lawyers, and extensive publicity of the proceedings will reveal all the shortcomings in their activities.
In conclusion, he said, "today we face a more difficult task than reforming law enforcement and the judiciary. We need to change people's attitudes towards law enforcement and the courts. Prove that the decision is right so that people believe in the court as much as they believe in the government. Undoubtedly, an important role in the implementation of this task facing the state belongs to advocacy, said the President of the Kyrgyz Republic.
Moreover, the chairman of the ABA Anar Baghirov greeted the President of the Kyrgyz Republic, the Chairman of the Bar Association of the Kyrgyz Republic, and other participants of the Congress in the Kyrgyz language on behalf of all Azerbaijani lawyers. He noted that it was a great honor to participate in this event in the capacity of a chairman of the ABA and thanked the Chairman of the Bar Association of the Kyrgyz Republic for the invitation. Continuing his speech in Russian, Anar Baghirov said that the joint participation of lawyers from both countries in various professional events creates favorable conditions for strengthening cooperation between the legal communities, noting that we share common values on all international advocacy platforms, both CIS and Turkic-speaking. We are strong friends and partners within the TURKAV Organization, which unites the representatives of the countries. I am convinced that our profession gains great dividends from such cooperation and exchange of experience, and given the nature and nature of advocacy, the establishment of strong and influential lawyers in our countries fully meets public goals and objectives.
In addition, A. Baghirov informed the participants about the activities of the ABA: "the ABA is a completely independent, non-governmental organization uniting all lawyers of our country and operating throughout the territory of the Republic of Azerbaijan. At the same time, I would like to emphasize that The Law on Lawyers and Legal Practice was adopted in 1999 as part of the judicial reform carried out in Azerbaijan under the leadership of the national leader of the Azerbaijani people Heydar Aliyev. He noted that in recent years, the state has paid due attention to strengthening the role and influence of the legal profession in Azerbaijan, improving advocacy.
A.Baghirov also noted that the ABA is self-financing, independently managed, is transparent at the admission of members, performs examinations with the participation of international organizations, and carries out disciplinary proceedings and imposition of sanctions based on international experience. In addition, A.Baghirov underlined the increase in the number of lawyers, in 2.5 times and the number of law offices more than 3 times the last 4 years.
Additionally, he mentioned, local and international cooperation, changes in the legislation in the field of advocacy, innovative and electronic activities, the place and role of advocacy in judicial reform, improvement of free legal aid, measures taken to improve the professionalism of lawyers. At the same time, he stressed that the reforms should focus on the financial independence of advocacy because, without financial independence, advocacy cannot be strong. In the end, he invited his Kyrgyz colleagues to participate in the trial in a lawyer's robe. Because if prosecutors and judges have uniforms, they must also have a lawyer.
Furthermore, A. Baghirov stressed that the ABA is always ready to support our colleagues from Kyrgyzstan in strengthening advocacy in the Kyrgyz Republic, to work together on issues deemed necessary, and to share successful experiences.
In conclusion, A. Baghirov expressed his deep gratitude to Mr. Bilim Rayimgulov, Chairman of the Bar Association of the Kyrgyz Republic, for his fruitful and useful cooperation, friendship, as well as for his efforts to establish mutual relations between the lawyers of both countries. In accordance with the decision of the Presidium, he solemnly presented a diploma and a symbolic lawyer's robe to Mr. Rayimgulov to be awarded the title of "Honorary Advocate of the Bar Association of the Republic of Azerbaijan".
